The motion states; “Defendant Mark Myrie respectfully renews his motion for an order releasing him from custodial confinement during the pendency of his direct appeal to the United States Court of Appeals for the Eleventh Circuit."
Buju's lawyer was also quoted as saying "defence was moving for the entry of a judgement of acquittal or, in the alternative, that the court grant the Reggae singer a new trial, based on the absence of substantial credible evidence sufficient to prove the [prosecution’s] allegations beyond a reasonable doubt”.
Buju was initially released on bail on November 10, 2010 on a $300,000 secured bond and a $25,000 corporate surety bond until a twelve member panel of jurors found him guilty on conspiracy to possess with the intent to distribute cocaine; attempted possession with the intent to distribute cocaine; using the wires to facilitate a drug-trafficking offence.
His lawyer says the bond set stringent pre-trial conditions and Myrie has complied with each of them.
